As weird as it may sound, technically, giro stole the database from avij's private property.
The site was on avij's private server, so if giro wanted avij to stop hosting, the only right thing to do would've been asking avij to hand over this data back to him. And avij would've been obliged to hand it over.
but he still is and will always be the founder and as such he has the right to do so.
as said : he only had the right to ask the data back, not copying them from a private server.
And looking at the actions (creating .eu,
as said : this domainname exists since months now, as this was a way to protect the domainname being bought by other people for other purposes than ebt.
spamming all the users with a one sided email to get them to dump .com for .eu)
tricky thing, but as giro decided to not give any information to his own community without this action 99% of the users would probably never have known what's going on. Communication doesn't seem to be giro's strongest point.

and the comments here on the forum, I can't help but notice that Giro's statement about Avij and Nerzhul has some truth about it. Avij and Nerzhul do act as if they own EBT. And ok they made some very important contributions to EBT, but they did it freely, nobody forced them to do it...as such they have no claim what so ever on EBT. If they didn't like the management, they just should have quit.
i agree only partially.
Giro left ebt for years and allowed avij and nerzhul to run the site. that was his decision, and he also allowed them to contribute extra features. As this implies the code of ebt is written for a great part (nerzhul claims 85% of the code isn't giro's); giro by his actions made other people co-owners of the code ! He seems to forget this: after his copying the database for the moment on ebt.com there's a code unning in which 85% is written by other people who get no credit at all fo it. And this is an action by a person (giro) who complains in his statement people are not giving crdit to him. it looks he's doing the same to and is not giving crecit to other people.. That's not very fair either, is it ?
Everybody knows that when you do voluntary work for someone that you are totaly dependent on the good will of that person to recognize and award you for it, you have no rights unless he gives it and the other way around he can't complain when the work you did was not to his satisfaction.
this isn't true. by giving permission to change the code, the people who wrote parts of the code gained rights.
And maybe it was a mistake from Giro to handle the issue in this way, but that didn't have to be followed by an even bigger mistake by Avij and Nerzhul. It is one thing to have a disagreement, it's whole other thing when you drag the whole community into it : which is exactly what Avij and Nerzhul did by creating the .eu and sending the email.
as said before, the .eu site was newly created.
as said before : if giro had communicated better, people who have been informed (i found out what's going on thanks to the people who changed their profile on ebt.com to ebt.eu)

i also thinks it's a very important issue that giro plans to make ebt gain money, as the site clearly stated it's a non-profit site which for me was a condition that had to be fulfilled before entering any notes.
If giro wants to make money from the site, i believe all bills being entered while the non-profit part is mentioned on the site cannot be taken into account for this purpose and have to be deleted..

Maybe it's an idea to find a mediator, someone who can get along with both sides... :roll:

We both know that this would not have happened. But by stating that you acknowledge that Giro is in charge and Avij was merely hosting the content, i.e. providing a service. So I do not think this contradicts snakefire77's point. Providing a service does not make you an owner of anything. (Except the money you normally get paid for it.)

Same for the code, they wrote it for Giro's website. They didn't charge him for that, okay. But if I program a software for my company (which I wouldn't if the company is not paying me - my fault if I still do), that doesn't make me the owner of that software. Or does it? I am not an expert on these legal issues.

Anyway Tom, you made some very good points in favour of the EBT.eu people which had not been said before. Thanks for that!

No problem...
I tried allready to contact both camps.
But none of them reacted to my proposal!
I have the impression that emotions have to calm down a bit.
Meanwhile more and more users turn their back to both camps and stopped entering notes to make clear to both camps that none of the both camps can live without the users entering notes!
I think this is the best way to act!
Let them stew a bit in their own truth and see how EBT is crumbling down due to their stupid raws....

I hope the negotiations will have an happy end, but I think negotiation can be helped stoppig the false immissions on the .com site; false immissions are a system to destroy all: in a war is very easy to make injuries, but it is very difficult to rebuild after.

PS (for Giro, if he is reading), and maybe also admit again the users who didn't false immissions, but only wrote "read the forum" and who are asking to be admitted again on the .com site (like me, for istans :wink: )

AFAIK, Giro isn't employing anyone. So everyone own the code they have written (unless copyright has been transfered).

I'm pretty sure some kind of middle ground can be reached. I don't know anybody who wants to put an end to the EBT-community. On an .eu or .com domain, with Giro in charge, or Avij/Nerzhul, or all three of them, there will always be at least one EBT.

Things like this happens before too and normally the notes will be moderated by moderators a short time after entering.

But the question is, if there is any moderator any longer other than Giro?

Well, if you donate a code to a website other than your own (e.g. EBT.com), that is some transfer of ownership to me.

But even if you are right, which you might be, my whole point was that mistakes were made on more than one side.

You'd be redirected to .com. The domain worked that way for some time now.
